The court held that it lacked jurisdiction to entertain the applicant's second application for sentence revision, as the matter had already been determined in Criminal Revision No 703 of 2018 by Kimaru J. The court found that it was functus officio and that the applicant's attempt to seek a different outcome on identical grounds amounted to an abuse of the court process. The proper recourse for the applicant, if aggrieved by the previous decision, was to file an appeal to the Court of Appeal, not to file a repetitive application before the same court. Consequently, the application was struck out as incompetent.
