The Court of Appeal found that there was a fatal procedural flaw in the trial of the appellants due to non-compliance with section 200(3) of the Criminal Procedure Code when Farah Amin J. took over the trial. The appellants were not properly informed of their rights to have witnesses recalled or to have the trial start afresh, and the evidence of several defence witnesses was irregularly recorded. This non-compliance materially prejudiced the appellants, as the succeeding judges did not have the opportunity to assess the credibility and demeanor of key witnesses, and the judgment was based on evidence taken in breach of mandatory procedural safeguards.
