Ratio Decidendi

The High Court lacks jurisdiction to review or reopen a sentence that has been upheld by the Court of Appeal. The Constitution and established jurisprudence strictly delineate the powers of the High Court, which does not extend to supervising or overturning decisions of superior courts. The Petitioner, having exhausted his appellate remedies, cannot invoke the High Court's jurisdiction to revisit the sentence. Any attempt by the High Court to review or annul decisions of the Court of Appeal would violate the constitutional hierarchy of courts and render such proceedings a nullity. The Petition is therefore incompetent for want of jurisdiction and must be struck out.
