The High Court found that the appellant had indeed pleaded for the release of the subject motor vehicle in the amended plaint, contrary to the trial magistrate's finding. The trial court's refusal to review its judgment on the basis that the relief was not sought was therefore erroneous. The appellate court held that the error was apparent on the face of the record and that the appellant was entitled to the relief sought. The court allowed the appeal, set aside the lower court's ruling, and ordered the respondent to release the vehicle to the appellant within seven days.
