The period of delay (about two months) was not inordinate. The court held that the applicant had met the threshold for extension of time under Section 79G of the Civil Procedure Act and Order 50 rule 6 of the Civil Procedure Rules. On the issue of stay of execution, the court found that the applicant had demonstrated apprehension of substantial loss if execution proceeded, and that the interests of both parties could be balanced by requiring the applicant to deposit the decretal sum as security....
