The Tribunal found that the application for summary judgment was premature as some respondents had filed an appeal (Tribunal Appeal No. 1 of 2020) prior to the current suit, and others had not been afforded an opportunity to file a defence. The requirements for summary judgment under Order 36 Rule 1 of the Civil Procedure Rules were not met, as the application was filed simultaneously with the statement of claim, denying respondents time to respond. Regarding leave to appeal out of time, the Tribunal accepted that service of the surcharge orders was disputed and, in the interest of justice and fair hearing, granted leave to the relevant respondents to file their appeal out of time.
