Ratio Decidendi

The Tribunal found that although the claimant's advocates did not formally seek the court's indulgence for their absence, their explanation—that they were present on the virtual platform but engaged in another matter and requested via the online chat for the file to be placed aside—was reasonable. The Tribunal accepted that the claimant acted diligently and promptly in seeking to reinstate the claim. In the interest of justice, and pursuant to Order 12 Rule 3(1) of the Civil Procedure Rules 2010, the Tribunal exercised its discretion to set aside the dismissal order and reinstate the suit for hearing on the merits.
