The High Court found that the trial court correctly held the appellant 100% liable for the accident. The respondent's evidence was consistent and corroborated by his daughter and the police officer, while the appellant's alibi was unsupported and his testimony inconsistent. The appellant failed to dislodge the evidence placing his vehicle at the scene. On damages, the court held that the trial court's award of Kshs. 900,000 was excessive in light of comparable authorities for similar injuries, and substituted it with Kshs. 700,000. The special damages of Kshs. 11,490 were upheld as strictly proved. Each party was ordered to bear its own costs of the appeal.
