The court found that the respondents' claim of a pending suit was unsubstantiated, as the application to revive Githongo ELC No 24 of 2019 had been dismissed and no valid appeal was filed. The Certificate of Confirmation of Grant had not been implemented since 2009, and all parties, including the respondents, were beneficiaries entitled to shares in the estate. The court held that eviction prior to distribution would not serve the interests of justice. Instead, the court ordered that a surveyor, with police security, identify the respective shares of each beneficiary as per the confirmed grant, thereby facilitating distribution without prejudicing any party's rights.
