The court held that there is no automatic right of appeal in probate matters from the High Court to the Court of Appeal. A party dissatisfied with a decision of the High Court in a probate matter must first obtain leave of the court before seeking to appeal. Since the applicant had not sought or obtained leave to appeal, the application for extension of time to file a notice of appeal was incompetent and could not be granted. The court further found that granting extension of time in the absence of a right to appeal would serve no meaningful purpose and would be superfluous. Consequently, the application was dismissed.
