The court found that the applicant failed to demonstrate substantial loss as required under Order 42 Rule 6(2) of the Civil Procedure Rules. The mere fact of execution or the appointment of parties as joint administrators does not, by itself, amount to substantial loss. The court emphasized that the requirements for stay of execution are conjunctive, not disjunctive, and since substantial loss was not established, the application could not succeed regardless of the promptness of filing or the issue of security. The court therefore dismissed the application for stay of execution pending appeal.
