The court held that, in the event of apparent inconsistency between the constitutional provision for equality and the statutory requirement for proof of contribution, the constitutional imperative prevails. Therefore, at dissolution of marriage, matrimonial property acquired during the marriage should be divided equally between the parties, regardless of individual contribution. Since the defendant did not contest the suit or provide alternative proposals, the court accepted the plaintiff's plea for equal distribution and ordered severance of joint ownership, sale of the property, and equal sharing of the proceeds.
