The High Court found that the trial court failed to resolve material contradictions in the prosecution evidence, particularly regarding when and to whom the complainant reported the alleged offence, and whether penetration occurred. The trial court also erred by not warning itself of the dangers of convicting on the uncorroborated evidence of a minor, as required by law. Furthermore, the trial court improperly made findings on the main charge after convicting on the alternative charge. These failures undermined the safety of the conviction.
