The High Court found that although the sentence imposed by the trial court was lawful and within its discretion, the applicant's willingness to compensate the complainants and the need for prison decongestion justified revision of the sentence. However, the applicant's negative antecedents and lack of trustworthiness made him unsuitable for an immediate non-custodial sentence without conditions. The court therefore substituted the consecutive custodial sentences with an order for compensation of Kshs.29,000 to the complainants, to be verified by the Deputy Registrar.
