The court found that the delay of more than two years in filing the application for extension of time was inordinate and not satisfactorily explained. Evidence showed that the typed proceedings were available as early as March 2019, and even if obtained in September 2019, the applicant failed to demonstrate any diligent effort to pursue the intended appeal or to make enquiries from her advocate. In the absence of a satisfactory explanation for such delay, the court held that there was no basis for granting the orders sought. The court emphasized that the exercise of discretion to extend time must be done judiciously and that unexplained inordinate delay precludes the granting of such relief.
