The court found that the Respondent failed to establish a valid reason for terminating the Claimant, as the alleged abusive conduct was not substantiated and did not amount to gross misconduct. Furthermore, the Respondent did not accord the Claimant a fair hearing as required by Section 41 of the Employment Act, 2007. The court held that the termination was both substantively and procedurally unfair under Section 45 of the Act. The Claimant was therefore entitled to remedies, including one month’s salary in lieu of notice, house allowance for the period worked, and compensation for unfair termination.
