The Court of Appeal held that the termination of the appellant's employment was substantively justified due to her poor performance, insubordination, and loss of trust, as evidenced by warnings and appraisals. However, the process was procedurally unfair because the appellant was not accorded a fair hearing in the presence of a representative as required by Section 41 of the Employment Act. The trial Judge's award of 5 months' salary as compensation for procedural unfairness was within the court's discretion under Section 49(1)(c) of the Employment Act, and there was no basis for appellate interference.
