Ratio Decidendi

The court found that there is no legal provision conferring upon the Applicant an automatic right to extension of the lease after its expiry. The law provides that upon expiry, the leasehold interest reverts to the Government as public land. The Applicant did not demonstrate that it had applied for or secured an extension before the lease expired, nor did it provide evidence of the length of the original leasehold interest. The court concluded that it cannot compel the Commissioner of Lands to extend an expired lease in these circumstances, and therefore dismissed the application.
