Procedural Posture

Environment and Land Case / Ruling on Objection to Late Filing of Pleadings and Right to Cross Examine

  1. 1 Whether the Attorney General, having filed pleadings and documents after the Plaintiff closed its case and without leave of court, can cross-examine witnesses or call witnesses.
  2. 2 Whether pleadings and documents filed out of time and without leave should be expunged from the court record.

Ratio Decidendi

The court found that the Attorney General filed the Memorandum of Appearance, Defence, and supporting documents after the Plaintiff had closed its case and without obtaining leave of court. The Civil Procedure Rules require strict adherence to timelines for filing pleadings. Allowing documents filed out of time and without leave would be prejudicial to the Plaintiff and contrary to the rules governing civil proceedings. The court therefore expunged the AG's pleadings and documents from the record and held that the AG, as the 3rd Defendant, had no right to cross-examine witnesses or call evidence in the matter.

Court Disposition

Objection upheld; Attorney General's pleadings and documents expunged; AG barred from cross-examining or calling witnesses.

Orders

  • The Memorandum of Appearance, Defence, and bundle of documents filed by the Attorney General on 23/05/2024 are expunged from the court record.
  • The 3rd Defendant (Attorney General) is barred from cross-examining any witness or calling witnesses.
