The Court of Appeal held that while it has original and discretionary jurisdiction to grant injunctions pending appeal, such jurisdiction is only exercisable where there is a positive and enforceable order from the lower court. In this case, the High Court merely dismissed the petition without making any positive order requiring a party to do or refrain from doing anything. Therefore, there was nothing capable of being stayed or restrained by injunction.
