Ratio Decidendi

The court found that no competent appeal was pending at the Court of Appeal because the appellant had only filed a Notice of Appeal, which lapsed after 60 days without a Memorandum of Appeal being filed. The court further held that the judgment sought to be stayed was a negative order, as it merely struck out the appeal with costs and did not require the appellant to do anything except pay costs. As such, there was nothing to stay except for the costs, and the application for stay of execution was therefore without merit. The court dismissed the application and vacated all interim and prior orders relating to execution.
