Ratio Decidendi

The court found that after the revocation of Gazette Notice No. 1617 of 1990 by Gazette Notice No. 3348 of 1991, there was no express revival of the previous interest rate control regime. Therefore, from 23rd July 1991 until 1st January 2001, there was no statutory interest rate cap, and the contractual rates of 30% and 24% agreed between the parties were valid and enforceable. The Plaintiff failed to prove that the Defendant charged unlawful interest, as the applicable law did not prohibit the agreed rates. However, the court found that certain charges levied by the Defendant, not being part of the agreed interest and lacking ministerial consent, were illegal but insignificant in amount....
