Ratio Decidendi

The High Court lacks jurisdiction to hear employment and labour relations matters following the establishment of the Industrial Court under Article 162(2) of the Constitution. Article 165(5) expressly forbids the High Court from hearing matters reserved for the Industrial Court. Precedent from both the High Court and the Court of Appeal confirms that all such matters, whether filed before or after the Industrial Court's establishment, must be heard by the Industrial Court. In the interest of justice and harmonization, the appropriate course is to transfer the present case, which concerns unfair dismissal (an employment dispute), to the Industrial Court for hearing and determination.
