Ratio Decidendi

The Environment and Land Court lacks jurisdiction to grant leave to file an appeal to the Court of Appeal out of time; such jurisdiction is vested solely in the Court of Appeal under the Appellate Jurisdiction Act and the Court of Appeal Rules. Furthermore, the applicant, not having been properly substituted as a party in place of the deceased defendant pursuant to Order 24 of the Civil Procedure Rules, lacked locus standi to bring the application. The application was therefore incompetent both for want of jurisdiction and for want of proper parties, and was dismissed with costs.
