Ratio Decidendi

The Court found that the applicant had demonstrated an arguable appeal on the grounds of jurisdiction of the Industrial Court and the respondent's locus standi. The Court further held that the appeal would be rendered nugatory if the stay was not granted, as the applicant, being a public body, would face difficulty recovering substantial costs from the respondent if the appeal succeeded, given the uncertainty of the respondent's financial capacity. The Court concluded that the respondent would not suffer prejudice by waiting for the appeal to be determined before proceeding to tax and recover costs, if entitled.
