Ratio Decidendi

The High Court found that the Small Claims Court properly exercised its statutory power to review its own judgment to correct a clerical error in the judgment sum, as the original claim was for Kshs. 138,580.00 but judgment was erroneously entered for Kshs. 38,580.00. The review was sought and allowed on the basis of an error apparent on the face of the record, and the appellant was afforded an opportunity to be heard, including making written submissions. The Small Claims Court Act and Rules provide a complete procedural code for such reviews, and the Civil Procedure Rules do not apply unless expressly incorporated. The appeal was therefore dismissed for lack of merit.
