Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the appellants have satisfied the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.
  2. 2 Whether the appellants will suffer substantial loss if stay is not granted.
  3. 3 Whether the application was filed without unreasonable delay.

Ratio Decidendi

The court found that while the appellants had filed the notice of appeal and the application for stay within the prescribed time and had offered to abide by any security conditions, they failed to demonstrate that they would suffer substantial loss if the stay was not granted. The evidence showed that the appellants were merely caretakers of the property in question and not owners or persons with registrable interest. The court held that caretakers cannot claim ownership or legal rights to the property and, therefore, cannot claim substantial loss from eviction. As the cornerstone requirement of substantial loss was not met, the application for stay of execution pending appeal was dismissed.
