Ratio Decidendi

The court found that the defendant bank acted negligently by listing the plaintiff as a loan defaulter with the CRB without prior notice or justification, despite the plaintiff servicing her loan through a check-off system. The error was admitted by the defendant and was attributed to a restructuring of the loan portfolio system. The bank failed to demonstrate diligence or provide the plaintiff with an opportunity to respond before the listing. Although the defendant took mitigating steps by delisting the plaintiff and informing KCB of the error, the court held that the initial unlawful listing caused the plaintiff financial embarrassment and temporary denial of credit facilities....

Court Disposition

Judgment for the plaintiff.

Orders

  • The plaintiff is awarded general damages of Ksh. 200,000 for financial embarrassment and unlawful listing with CRB as a loan defaulter.
  • The plaintiff is awarded costs and interest.
