Execution Application / Ruling on Renewed Application for Oral Examination of Directors in Execution Proceedings

  1. 1 Whether the Claimant has remedied previous defects in the application for oral examination of the Respondent's directors.
  2. 2 Whether summons should issue against all named directors for oral examination regarding satisfaction of the decree.

Ratio Decidendi

The Court found that the Claimant had addressed the procedural defect identified in the earlier application by naming all directors of the Respondent for oral examination. There being no opposition from the Respondent and the matter having remained unresolved for 14 years, the Court determined that it was just and necessary to summon the directors to facilitate satisfaction of the decree. The Court further directed that all execution-related proceedings should be conducted before the judge who delivered the judgment, ensuring continuity and proper oversight. The orders sought were therefore granted to expedite closure of the matter.
