The court found that the respondent failed to provide sufficient corroborative evidence implicating the claimant in the alleged attempted theft. The only evidence was the word of a colleague, Nathan, who was not called to testify. The claimant denied the allegations and did not sign any admission. The employer did not discharge its statutory burden under Sections 43(1) and 47(5) of the Employment Act to prove a valid reason for dismissal. Consequently, the termination was held to be unfair within the meaning of Section 45(1) of the Employment Act. The claimant was entitled to compensation, notice pay, accrued leave, costs, and a certificate of service, subject to statutory deductions.
