The court held that while the Environment and Land Court has exclusive jurisdiction over substantive land disputes, the present appeal concerns the execution of a decree in light of subsequent succession proceedings and an appeal in a probate and administration matter. Since the Environment and Land Court does not have jurisdiction in succession matters, and the appeal requires interpretation of the effect of succession proceedings on the execution of the land tribunal decree, the High Court is the appropriate forum to determine the issue. The court therefore overruled the preliminary objection and affirmed its jurisdiction to hear and determine the appeal.
