The tribunal found that although the landlords served a valid notice to terminate the tenancy and the tenants did not file a reference to oppose it, the landlords' continued acceptance of rent from the tenants after the notice took effect and after lease expiry resulted in the creation of a controlled periodic tenancy under section 60(2) of the Land Act, 2012. This acceptance of rent superseded the termination notice and lease, entitling the tenants to continued occupation on a month-to-month basis.
