Civil Appeal / Ruling on Application for Stay of Execution and Release of Attached Property Pending Appeal

  1. 1 Whether the continued attachment and storage of the applicants. vehicles was lawful after objection proceedings were filed.
  2. 2 Whether the decree holder is entitled to storage charges after the decretal amount and auctioneer charges were paid.
  3. 3 Whether the vehicles should be released to the applicants pending the hearing of the appeal.

Ratio Decidendi

The court found that the continued attachment and storage of the applicants. vehicles was unlawful once objection proceedings were filed and notices received by the court, as the relevant rules mandate a stay of execution in such circumstances. The decree holder was not entitled to storage charges after the decretal amount and auctioneer charges had been paid, as any continued detention of the vehicles was at his own risk. The vehicles should be released immediately to the applicants, and the application for stay was allowed pending the hearing of the appeal on the objection proceedings.
