Miscellaneous Application / Ruling on Application for Joinder of Interested Parties

  1. 1 Whether the Intended Interested Parties should be enjoined in the suit as interested parties.
  2. 2 Whether the applicants' interest as tenants is sufficient to warrant their joinder in a dispute over land ownership.

Ratio Decidendi

The court found that the core dispute in the suit is over the ownership of the suit land between the plaintiff and the defendants, and that the applicants, as tenants whose lease commenced after the suit was filed, do not have an interest sufficient to warrant their joinder as interested parties. The court held that their involvement is not necessary for the effectual and complete adjudication of the issues in the suit, as any prejudice they may suffer can be addressed by their landlords, the 1st and 3rd Defendants, who failed to disclose the pending litigation at the time of entering into the lease. The application for joinder was therefore dismissed as unmerited.
