Ratio Decidendi

The court found that the appeal was lodged without leave and together with the application for extension of time, contrary to the proper procedure. There is no legal provision allowing an appeal to be filed first and then validated by subsequent leave; leave must be sought and granted before the appeal is filed. The application and the appeal were both found to be incompetent and invalid. The court further noted that the application should have been filed as a miscellaneous application, and only upon grant of leave should an appeal file be opened. As a result, both the appeal and the application were struck out as incompetent.

Orders

  • The Appeal and the Notice of Motion dated 16/06/2017 are hereby struck out.
