Procedural Posture

Miscellaneous Application / Interlocutory Order on Application to Sue as Pauper

  1. 1 Whether the applicant has provided sufficient documentary evidence to support her application to sue as a pauper.
  2. 2 Whether the applicant's allegations demonstrate a cause of action as required under Order 33 Rule 5(d) of the Civil Procedure Rules.

Ratio Decidendi

The court held that before it can determine whether the applicant should be granted leave to sue as a pauper, it must be satisfied that the applicant's allegations demonstrate a cause of action, as required by Order 33 Rule 5(d) of the Civil Procedure Rules. To make this determination, the applicant must provide documentary evidence supporting her claims, including proof of her alleged interest in the property, copies of relevant criminal judgments, and any complaint letters referenced. The court therefore directed the applicant to file a further affidavit annexing these documents within 30 days, after which the application would be further assessed.

Court Disposition
