The Court of Appeal held that upon service of a valid notice to terminate a controlled tenancy, if the tenant objects but fails to file a reference to the Business Premises Rent Tribunal within the statutory period, the notice takes effect upon expiry of the notice period. This terminates the landlord/tenant relationship, and the Tribunal's jurisdiction ceases. The High Court, therefore, had jurisdiction to entertain the landlord's suit for vacant possession and mesne profits. The appellants' defence and replying affidavit did not raise any triable issues, as the validity of the notice and the existence of a controlled tenancy could only be challenged before the Tribunal, not the High...
