Ratio Decidendi

The tribunal found that the claimant failed to provide sufficient evidence to support the claimed amount of Kshs. 273,071.10. The only proven amount, as evidenced by the respondent's member statement, was Kshs. 253,071.10 as at 30/6/2022. The tribunal held that, in the absence of proof for the higher figure, it could only award the amount substantiated by documentary evidence. The respondent's reliance on AGM resolutions to stop refunds due to liquidity issues did not negate the claimant's right to a refund of the proven amount. Accordingly, judgment was entered for the claimant for Kshs. 253,071.10 plus costs and interest at tribunal rates from the date of filing.
