The conviction was unsafe because the plea of guilty was not unequivocal and the facts presented by the prosecution did not support the charge of trafficking in narcotic drugs. The prosecution failed to provide an analyst's report to conclusively prove that the substance was cannabis sativa, as required by Section 74A of the Narcotic Drugs and Psychotropic Substances (Control) Act. The trial magistrate also failed to record the language used and did not strictly comply with the mandatory procedure for plea taking. These procedural and evidentiary lapses rendered the conviction unsound, justifying the appellate court's intervention to quash the conviction and set aside the sentence.
