There was no evidence that the Defendant had entered into any agreement with Mr. Tanzini prior to or after the sale agreements, and the Plaintiff herself authorized the construction by Mr. Tanzini. The Plaintiff's refusal to complete the agreements on the basis of alleged non-disclosure was not justified, as she had the right to refuse permission for the construction but instead acquiesced.
