Ratio Decidendi

The court held that the general rule is that costs follow the event and are awarded to the successful party unless there are good reasons to depart from this principle. The 2nd defendant was not found at fault and was exonerated by the consent judgment between the plaintiff and the 1st defendant. The court found no legitimate reason to deny the 2nd defendant costs. However, since the 1st defendant settled the matter before a full hearing, the court exercised its discretion to award the 2nd defendant half costs of the suit, to be borne by the 1st defendant.
