Procedural Posture

Notice of Motion / Ruling on Interlocutory Injunction Application

  1. 1 Whether the Plaintiff has established a prima facie case with a probability of success to warrant the grant of a temporary injunction.
  2. 2 Whether the Plaintiff has demonstrated ownership of the suit properties or established fraud in the transfer to the 2nd Defendant.
  3. 3 Whether the conditions for granting an interlocutory injunction as set out in Giella v Cassman Brown have been satisfied.

Ratio Decidendi

The Plaintiff failed to establish a prima facie case with a probability of success as she did not produce any documentary evidence of ownership of the suit properties or any evidence to substantiate her allegations of fraud in the transfer to the 2nd Defendant. The 2nd Defendant, on the other hand, demonstrated that he conducted due diligence, purchased the property for value, and obtained proper title. The law requires strict proof of fraud, which the Plaintiff did not provide. As the first condition for granting an interlocutory injunction was not met, the court was not required to consider the other conditions. Consequently, the application for a temporary injunction was dismissed.
