The court found that the applicant's advocates were aware of the ruling as it had been forwarded to them by registered post on 8th November 2019, and this evidence was uncontroverted. The delay in filing the application for enlargement of time was deemed inordinate and not satisfactorily explained. The outbreak of the COVID-19 pandemic occurred after the time for filing the appeal had already lapsed and thus did not constitute a reasonable explanation for the delay. Applying the principles set out by the Supreme Court in Nicholas Kiptoo Arap Korir Salat v IEBC & 7 others, the court held that the applicant had not met the threshold for the exercise of discretion to enlarge time....
