Applying the principles from Giella v Cassman Brown and subsequent authorities, the court held that the applicant had not sufficiently demonstrated entitlement to a temporary injunction but that, in the interests of justice and to preserve the subject matter of the appeal, a preservation order maintaining the prevailing status quo over the suit land was appropriate.
