The Court of Appeal held that the High Court lacked jurisdiction to apportion assets and revenue between Narok County Council and Trans Mara County Council. Section 270 of the Local Government Act expressly provided that such apportionment was to be made by agreement between the councils or, in default, by direction of the Minister for Local Government. The High Court could only intervene by way of judicial review to enforce compliance with the statutory process, not to undertake the apportionment itself.
