The Tribunal found that the written lease between the Landlady and Alvin Sasia expired by effluxion of time and was not renewed or extended. There was no evidence of a controlled tenancy arising after expiry, as required by the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The mere fact of sub-letting by the head tenant did not establish a continued tenancy or controlled tenancy. Consequently, Alvin Sasia had no legal standing as a tenant and could not be joined as a party.
