Ratio Decidendi

The court found that the plaintiff had established, on a balance of probabilities, that he was the legal representative of the registered owner of the suit premises and that the defendant's father was a tenant who paid rent until 1982. After the death of the defendant's father, the defendant took possession as executor but failed to pay rent from January 1983 onwards. The defendant did not adduce any evidence to support the counter-claim of adverse possession. The court held that the plaintiff was entitled to eviction of the defendant, mesne profits at Kshs.100 per month from January 1983 to February 2006, and costs. The counter-claim was dismissed for want of evidence.
