The Environment and Land Court found that it lacked jurisdiction to grant an injunction pending appeal after it had rendered its decision and a notice of appeal had been filed in the Court of Appeal. The court held that under Order 42 Rule 6(6) of the Civil Procedure Rules, its power to grant an injunction pending appeal is limited to instances where it is exercising appellate jurisdiction. Since the applicant had already filed a notice of appeal and the matter was now before the Court of Appeal, the proper forum for seeking an injunction was the Court of Appeal under Rule 5(2)(b) of the Court of Appeal Rules.
