The Court of Appeal held that, although the words 'loss of earnings' or 'loss of future earnings' were not expressly used in the plaint, the substance of the appellant’s pleading in paragraph 8, coupled with the evidence adduced, was sufficient to constitute a proper claim for loss of earnings and loss of future earnings. The lower courts erred in failing to assess and award damages under these heads.
