The delay of seven days from discovery of the judgment was not inordinate. The intended appeal was found to be arguable, particularly on the issue of whether the decretal sum was excessive. The court held that the applicant would suffer substantial loss if execution proceeded, as there was a real risk that the respondent would be unable to refund the decretal sum if the appeal succeeded.
